So you can't just theoretically warn him now for it? I mean I can understand if someone posted some spammy response months ago and got away with it. But Pyro's post wasn't made that long ago.

Logical policy doesn't support retroactive warning. After all, if you pull a dump of Null (Garbage) posts from 7/04 - 10/04, we'd be drowning in punishments to hand out.

What the hell !
It was complete unfair.
Everyone can make jokes and don't get warm but i get, that was the most lame thing I have ever seen.
And that wasn't SPAM!!!! THAT WAS A JOKE LIKE EVERYONE MADE !!!!!

Who, indeed, is "everyone"? When you first posted this topic, how did you know that "everyone" didn't get a warning? Did you even try to contact people in a mature and sensible manner?
As a rule of thumb, putting on a tantrum like this is a breach of policy in and of itself and absolves you from any change at an evaluation of your position. If you don't understand my vocabulary: If you cry, we will never feel like overturning a warn.
