His reasoning is since he isn't downloading it, it's legal.. Not sure if that is true or not... I'm pretty sure you have to buy the license to play the game regardless..
But I would consider NES games abandonware if you ask me

Read the ROM article on Nintendos stance, they don't accept abandonware as an excuse.
